beSharpCloud is a Personal Health Record (PHR) platform that allows users to store, organize, and view their health information and that of their family group or pets. beSharpCloud is not a medical or health service provider.

Welcome to beSharpCloud. By using our application and services, you agree to the following terms. Please read carefully, as this is a binding agreement.
2. NOT A MEDICAL SERVICE
No Diagnosis: Information generated, processed, or displayed in beSharpCloud is for informational and personal organization purposes only. AI and Accuracy: The use of Artificial Intelligence (AI) for study transcription or medication reminders is an assistance tool. You acknowledge that AI can make errors and it is your sole responsibility to verify the accuracy of data against original documents issued by professionals. Emergencies: In case of a medical emergency, do not use beSharpCloud. Immediately contact the emergency services in your area.
3. User Responsibility
You are solely responsible for: • The accuracy of information uploaded to the platform. • Maintaining the confidentiality of your access credentials. • The use of the "Medications" feature and adherence to doses prescribed by your doctor. beSharpCloud is not responsible for omissions, dosage errors, or lack of treatment adherence. • Third-party data: you may only upload health data of family members, pets, or dependents under your care or with their explicit consent. You must not upload identifiable information of third parties without authorization.
4. Artificial Intelligence and Data Use
By using the scanning and automatic organization features, you agree that your documents will be processed by third-party AI models (Google Cloud Vertex AI). beSharpCloud guarantees that such processing is carried out under corporate privacy standards and that your data is not used to train public models.
5. Data Ownership and Software License
Your health data belongs to you. beSharpCloud acts solely as a digital custodian. You can export or request the deletion of your information at any time, subject to technical retention policies described in our Privacy Policy. Software license: beSharpCloud and its underlying software, trademarks, and content are the intellectual property of beSharpCloud. You receive a personal, non-exclusive, non-transferable, revocable license to use the application for its intended purpose. You may not copy, reverse-engineer, decompile, sublicense, or build derivative works based on the platform.
6. Limitation of Liability
To the maximum extent permitted by law, beSharpCloud and its developers shall not be liable for direct, indirect, incidental, or consequential damages arising from the use or inability to use the service, including but not limited to errors in medication loading or interpretation of studies.
7. Acceptable Use
When using beSharpCloud, you agree NOT to: • Upload data of identifiable third parties without their authorization. • Use the service for any unlawful purpose or in violation of applicable health, data protection, or consumer regulations. • Attempt to scrape, mass-export, automate, or reverse-engineer the platform. • Interfere with the security or integrity of the service (e.g., probing, exploiting vulnerabilities, uploading malicious content). • Impersonate another person or misrepresent your relationship with a dependent. • Resell, white-label, or redistribute the service without a written agreement with beSharpCloud. We may suspend or terminate accounts that violate this section.
8. Account Suspension and Termination
Your right to use beSharpCloud ends if: • You delete your account from the application. • You materially breach these Terms or the Acceptable Use rules above. • A regulator, court, or law enforcement requires us to suspend your access. • Your subscription lapses and you do not reactivate within the grace period. We will notify you by email when reasonably possible before suspension, except in cases of urgent legal, security, or abuse-related risk. You may appeal a suspension by writing to soporte@besharpcloud.com. Upon termination you may export your data within 30 days; after that, your data is deleted in accordance with our Privacy Policy retention rules.
9. Subscriptions, Payments, and Cancellation
beSharpCloud may offer free and paid plans. Paid plans are processed by third-party payment providers (e.g., Lemon Squeezy, Apple, Google Play). The applicable price, billing cycle, taxes, and currency are shown at checkout. • Auto-renewal: paid subscriptions renew automatically at the end of each cycle unless cancelled before the renewal date. • Cancellation: you can cancel at any time from the billing settings or through the store where you subscribed (Apple, Google Play). Cancellation takes effect at the end of the current paid period; you keep access until then. • Refunds: except where required by applicable consumer law, payments for completed billing cycles are non-refundable. Store-mediated refunds (Apple, Google) follow the policies of those stores. See our Refund Policy. • Free trials and promotional pricing: terms are disclosed at signup; lapsed trials convert to paid plans unless cancelled in time. • Price changes: we will notify you in advance and you may cancel before the new price takes effect.
10. Modifications
We reserve the right to modify these terms. When this occurs, you will be asked to accept the new version before continuing to use the application.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Wyoming, United States of America, without regard to its conflict-of-laws principles. Any dispute arising from or related to these Terms or the use of the service shall be resolved in the state or federal courts located in Wyoming, USA, and you consent to the personal jurisdiction of such courts. If you reside in a jurisdiction that grants mandatory consumer-protection rights (e.g., EU/UK consumer law, Argentine consumer law, Brazilian CDC), nothing in this section shall deprive you of those rights, and you may bring claims before the courts of your place of residence where such rules so provide.
